Basic legal tenets are vital to carry on social and cultural aspects in India, Bangladesh and other South Asian countries. It is important in the sense to carry on our societal and cultural norms. The said job is not only to perform but rather it should be performed in such a manner our social, cultural and political situation turns out to be pleasant and amiable one. But sometimes under exceptional circumstances we find that basic legal tenets are not utilized in its proper perspectives in India, Bangladesh and other South Asian nations.
As this writer hails from Indian city of Kolkata so it is imperative on my part to focus upon this burning issue chiefly upon India and Bangladesh as I am deeply intimated with Bangladesh. If I throw light about Indian perspectives, then it is easily deciphered that still proper legal judgements are not meted out to macro sections of Indian populace. Richer and higher middle classes are eating up the fruits of success of legal judgment but sad part is that lower middle classes cum poorer ones are the worst affected in terms of attaining proper legal judgment.
Though the present political regime has set up Lok Pal under the dynamic leadership of former judge of Supreme Court of India and noted legal luminary of Indian from Kolkata Retired Justice Pinaki Chandra Ghosh based at the Indian capital city New Delhi. Despite appointment of Retired Justice Ghosh in this coveted post but yielding of proper results will take a long time.
Despite all the provocations Retired Mr Justice Ghosh will continue in his endeavor to render proper and transparent legal judgements for the people of the country. It is sincerely believed that other legal luminaries will follow the path as shown by Retired Mr Justice Ghosh. But country's administrators should adhere the norms of basic legal tenets all over India. Thus in the subsequent paragraph it is my humble task to appeal to the citizens as well as to the politicians about how to ensure proper utilization of legal tenets.
How to ensure proper utilization of legal tenets in India?
India is a vast nation with population of around 135 crores. All around the country there are people of diverse religions and languages in her 29 states and 9 union territories. Population pressures are so burgeoning that there arise differences of opinion which ultimately lead to political, social and legal skirmishes. Anyhow whatever basic tenets of law has been inscribed in Independent India's constitution should be strictly adhered to by the entire nations. However, there are some common ways and means by which we can establish proper utilization of legal tenets in India. Some of the common ones are stated as follow:
There should be privacy of individual law in India
All section of Indian populace should be rendered with proper legal justice.
If any legal hearing taking place in different courts of India there should be speedy and proper judgment.
There should not be any hide and seek in any sort of information to people of lower middle, poor and deprived sections of Indian populace.
Civil cases in India should be speedily solved.
Politicians should not be allowed to have upper edge the process of rendering any sort of legal judgment to the nations.
Basic tenets of Law in India
* There should be equal judgment among all sections of Indian populace.
* There should be proper transparency while delivering proper legal judgment.
* Poorer sections of Indian populace should not be cheated at all in the process of delivering legal judgments.
* There should not be any malpractices during the time of both parliamentary and assembly elections of India.
* Corporate bodies of India must ensure proper utilization of basic legal principles or tenets for social justice.
Types of law in India
As I am writing about proper utilization of legal tenets or principles it is also mandatory on my part to state different types of law prevalent in India. These are: Common Law, Income Tax Law, Municipal Law, Criminal Law, Civil Law, Personal Law, Corporate Law, Family Law and Personal Law.
Summing up the above inference one point becomes aptly clear in our mind that whatever position we hold aloft in Indian societies it is our humble responsibilities to adhere to basic tenets of law and its proper utilization. Otherwise our society and its function will be in utter disarray. I feel same norms should be strictly adhered to in Bangladesh also. Even in various Western nations it is accorded equal importance which cannot be denied by rational cum analytical minded societies of both India and Bangladesh.
