Hosaf Group Chairman Moazzam Hossain has been relieved from the charges of Dinajpur's Barapukuria coalmine corruption case filed in 2008.
The High Court on Wednesday scrapped the proceedings of the case against him. HC bench Justice Md Zakir Hossain and Justice KM Rasheduzzaman Raja delivered the verdict after hearing a petition filed by Moazzam Hossain seeking the cancellation of the case proceedings.
Earlier, on 27 November 2024, a trial court framed charges against four individuals, including Moazzam. At that time, then BNP Chairperson Khaleda Zia, the party's standing committee member Khandaker Mosharraf Hossain, and Vice Chairman Air Vice Marshal (Retd) Altaf Hossain Chowdhury were exempted from the case. Later, several others were also discharged due to their deaths.
Challenging the legality of the charge framing, Moazzam Hossain filed the petition with the High Court last year.
After a preliminary hearing on January 27 last year, the High Court stayed the proceedings against him and issued a rule asking why the proceedings should not be scrapped. Yesterday, the High Court made the rule absolute and delivered its judgement.
Senior lawyer ABM Altaf Hossain and lawyer Khandaker Maruf Hossain appeared for Moazzam, while lawyer Shaheen Ahmed appeared for the Anti-Corruption Commission. Following the verdict, Barrister ABM Altaf Hossain told reporters that Moazzam Hossain had been accused of abatement in the case. Since the principal accused had already been acquitted, the case could not proceed against an alleged accomplice.
The ACC filed the case against Khaleda Zia and 15 others with Shahbagh Police Station in Dhaka in 2008.
On October 5, the same year, the ACC submitted a charge sheet against 16 accused individuals.
