Appellate Division shields EX CJ Khairul Haque from arbitrary arrests
The Appellate Division has upheld a High Court order barring authorities from showing former chief justice ABM Khairul Haque arrested or harassing him without a specific case.
A four-member bench led by Chief Justice Zubayer Rahman Chowdhury disposed of the state's challenge to the High Court order on Sunday.
Justice Khairul's lawyers included Kamrul Haque Siddiqui, Sara Hossain, Mostafizur Rahman Khan, Mahbub Shafik and Monaem Nabi Shaheen.
Deputy Attorney General Mohammad Mehedi Hasan Chowdhury represented the state.
After the former chief justice secured bail from the High Court, police showed him arrested on Mar 30 in two murder cases filed with Jatrabari and Adabor police stations.
His son, lawyer Ashiq-ul Haque, challenged the legality of the move on May 13. The High Court subsequently ordered that he not be shown arrested or harassed without a specific case.
The state challenged that order, but the Appellate Division has now disposed of its petition.
Justice Khairul became Bangladesh's 19th chief justice in 2010. He later chaired the Law Commission before resigning in August 2024 after the Awami League government fell.
He was arrested a year later and has since been shown arrested in nine cases.
