Justices removed on different grounds


So far twenty two justices have been removed since independence on a number of grounds according to associated sources. Among them the highest number of justices were impeached during the reign of former autocratic president Ziaur Rahman. Twelve of these justices were reappointed by the Awami League government in 2009.

Reportedly justices were removed from their posts in various ways. In 1976 former president Ziaur Rahman reduced justices' retirement age from 65 to 62 years. Justice AMF Ahsan Uddin Chowdhury lost his job as soon as the retirement age was curtailed by Ziaur Rahman. Justice Syed AB Mahmud Hussain, Ruhul Islam, Debesh Chandra Bhatta-charya, Siddique Ahmed Chowdhury and Abdul Mumit Chowdhury also lost their jobs for the same reason.

On the other hand, former president Hussain Muhammad Ershad had declared an order that chief justice would be allowed to retain his post till the age of 62. Through the issuance of this order Justice Kamal Uddin's job came to an end on 11th April 1982. At around the same time justice Kazi Mahbubus Subhan lost his job on 16th June 1982 on charges of taking bribe from Barrister Shawkat. Another two justices were removed during that time who were Justice ASM Hossain and Justice Abdur Rahman.

Awami League government temporarily appointed 18 justices at High Court Division in 2001. But their service was not later on regularized when Bangladesh Nationalist Party (BNP) came to power. One of the justices passed away among these 18 justices while Mesbah Uddin, KM Shafiuddin and Mansur Ul Haque stayed back as lawyers.

Awami League government reappointed several justices in March 2009 who were Justice Mohammad Nizamul Haque, Justice Abdul Malek, Justice Abdur Razzak, Justice Hasan Fayez Siddiqui, Justice Mamtaz Uddin, Justice Abdus Salam, Justice Shamsul Huda, Justice Faruq, Justice Abdul Hai, Justice Marjul Haque, Justice AHM Shamsuddin Chowdhury and Justice Mohammad Bazlur Rahman.
 
Relevant sources have informed that another four justices were terminated from service after independence on the basis of different irregularities who were Mohammad Latifur Rahman, Faysal Mahmud Fayez, AK Badrul Haque and Syed Shahidur Rahman. It may be added that chief justice Surendra Kumar Sinha sent his resignation letter to President Abdul Hamid on 11th November 2017.
