Appellate Division postpones HC order on shown arrest
The Appellate Division has stayed the High Court's order stating that no person can be subjected to "show arrest," arrested, or harassed in any other way if there is no specific case against them. At the same time, the court has directed that the High Court rule regarding this matter be disposed of within four weeks.
The order was passed on Wednesday (29 July 2026) by the Appellate Division headed by the Chief Justice.
Earlier, a High Court bench comprising Justice Rajik Al Jalil and Justice Debashish Roy Chowdhury had ordered that no one could be arrested without a specific case. The High Court also issued a rule seeking an explanation on why arrests should not be prohibited without a specific case.
The Appellate Division today directed that the High Court rule be resolved within four weeks.
Regarding the matter, Attorney General Mohammad Ruhul Quddus Kajol said that there was a concern that the High Court's order could obstruct independent investigations by investigative agencies. He said that if such a law existed, law enforcement agencies would not have the opportunity to take action even if they had specific evidence against someone.
He further stated that the court has set next Sunday for a hearing on showing former Chief Justice A.B.M. Khairul Haque arrested in a new case.
